A majority of the electors voting thereon having approved, at a special question election held on the 1st day of August, 2006, the levying of a retailers’ sales tax in the City of Ellinwood, for the purpose of funding one-half of revenues to recreation and one-half of revenues to street improvements, as authorized by K.S.A. 12-187 et seq., as amended, there is hereby levied a city retailers’ sales tax in the amount of one-half of one percent (0.5%) to take effect on the 1st day of January, 2007.

The following are designated as main trafficways of the city pursuant to K.S.A. 12-685 et seq. for purposes of bond financing certain improvements:

Schiller Street from 5th Street to 7th Street,

Bismark Street from 6th Street to 7th Street,

Bonita Place from Bismark to Schiller,

Bonita Drive from Bismark to Schiller,

Main Street from city limit to city limit within the corporate limits of the City,

West 1st Street (from Humbolt Ave. to Kennedy Ave.),

Wilhelm Ave (from 1st Street to 3rd Street),

West 2nd Street (from Kennedy Ave. to Wilhelm Ave.),

South Main Street (from Santa Fe (US 56) to “A” Street including intersections),

East 2nd Street (from Schiller Street to Wieland Street including the intersections) and

East 1st Street (from Bismark Street to Goethe Street including the intersections).

(a)   Pursuant to K.S.A. 12-1757 to 12-1768, as amended, there is hereby created a public building commission to be known as the Public Building Commission of Ellinwood, Kansas (the “Commission”), which shall be a municipal corporation.

(b)   The Commission is created for the purposes of acquiring a site or sites for and constructing, reconstructing equipping and furnishing a building or buildings or other facilities of a revenue-producing character, including parking facilities, or for purchasing or otherwise acquiring such building or buildings or facilities. The building or buildings or facilities shall be maintained and operated for a county courthouse, the housing and accommodation of county offices or county business or for city offices or such other purposes as are commonly carried on in connection with such facilities or in county courthouses and general city buildings, including administrative offices for school districts and housing, accommodations and parking facilities for offices of state and federal agencies. The Commission shall have all of the power and authority conferred upon it pursuant to K.S.A. 12-1757 to 12-1768. The Commission shall have the power to do all things necessary or incidental to the purpose of constructing or acquiring or enlarging, furnishing and equipping and operating and maintaining buildings to be made available for use by governmental agencies. The Commission shall have the authority to issue revenue bonds and fix rental rates, fees and charges sufficient at all times to pay the maintenance and operation costs of the buildings and retire any bonds issued for their construction. The Commission established herein shall have the power to acquire the fee simple title to real estate and shall have the power to acquire property by purchase, gift, devise or by the exercise of the power of eminent domain of the state and title shall be taken in the corporate name of the Commission.

(c)   The commission shall consist of the five (5) Councilmembers and the Mayor, who shall be the same persons as those persons then serving on the governing body of the City of Ellinwood, Kansas. The commissioners shall serve the terms on the Commission which are simultaneous with their terms on the governing body of the City of Ellinwood, Kansas. The commissioners shall serve without compensation.

(a)   In accordance with the provisions of K.S.A 12-1,117 and amendments thereto, there is hereby established a Municipal Equipment Reserve Fund, which shall be used by the City of Ellinwood, Kansas to finance the new and replacement equipment necessary for the efficient and effective performance of the various functions and services of the City of Ellinwood, Kansas. For the purpose of this section, equipment shall include machinery, vehicles and any other equipment or personal property, including, but not limited to, computer hardware and software, which the City of Ellinwood, Kansas, is authorized to purchase for municipal purposes.

(b)   Moneys credited to the Municipal Equipment Reserve Fund from annually budgeted transfers shall not thereafter be subject to the provisions of K.S.A. 79-2925 to 79-2937 inclusive, and amendments thereto. Moneys for said fund may be budgeted and transferred to said fund from any source which may be lawfully used for such purposes, including equipment use and charges on the various departments and agencies of the city to finance new and replacement equipment.

(c)   Moneys in said Municipal Equipment Reserve Fund shall be invested in accordance with the provisions of K.S.A. 10-131 and K.S.A. 12-1675 and amendments thereto, with interest earnings credited to such fund.

(d)   If the Governing Body determines that money which has been credited to such fund or any part thereof is not needed for the purposes for which so budgeted or transferred, the governing body may transfer, by adoption of a resolution such amount not needed to the fund from which it came and such retransfer and expenditure thereof shall be subject to the budget requirement provisions of K.S.A. 79-2925 to 79-2937, inclusive and amendments thereto.
